$95,000 Jury Verdict Against Experian for Mixed Credit Report Errors
In July 2026, Consumer Justice Law Firm won a unanimous $95,000 jury verdict on behalf of Ronald Alexander Garcia Delgado in a lawsuit against Experian, one of the three largest credit reporting agencies in the nation, also known as the credit bureaus.
The case centered on a serious credit reporting error in which Experian mixed Garcia Delgado’s credit file with negative information belonging to his son, despite significant differences in their identifying information, including a twenty-four year age gap.
The evidence presented at trial showed that Experian linked the two individuals based largely on a shared first name and address, causing Garcia Delgado to be denied credit while attempting to establish a new life in the United States after immigrating from Venezuela. The jury agreed that Experian failed to follow reasonable procedures to assure maximum possible accuracy as required by the FCRA.
Garcia Delgado is represented by our Managing Partner David Chami, Managing Attorney James Ristvedt, and attorney McKenzie Czabaj. Throughout the trial, this team strategically navigated several issues, including demonstrating how to convey the harm and impact of Garcia Delgado’s story to a rural Texas jury while relying on Spanish interpreters for the plaintiff and several witnesses.
This case highlights the importance of protecting consumers from credit reporting inaccuracies, which can have devastating consequences for access to housing, transportation, and financial opportunities.
Press release coverage from media outlets like Business Insider and NewsBreak helped bring national attention to this case and the ongoing problem of inaccurate credit reporting, which has significant real-world impacts every year.
Nearly $3 Million FCRA Verdict Against Horizon Bank
In another significant consumer rights victory, attorney Duran Keller secured a $2,865,000 federal jury verdict for Fabian Huizar in a Fair Credit Reporting Act case against Horizon Bank. The lawsuit alleged that the bank continued reporting that Huizar owed a vehicle loan debt even after an Indiana court had ruled that the repossession was improper and that no balance was owed.
According to the evidence presented at trial, Huizar repeatedly disputed the inaccurate reporting. Despite being notified through the credit reporting dispute process, Horizon Bank allegedly continued verifying the debt as valid. The jury ultimately found in favor of Huizar, recognizing the substantial harm that can result when lenders and furnishers fail to report accurate information.
Though attorney Keller represented Huizar as his personal client, having begun litigation on this matter years prior to joining the firm, he has been a partner at Consumer Justice Law Firm since March 2026.
The verdict serves as another reminder that consumers have important rights when it comes to Fair Credit Reporting Act (FCRA) violations, and that the companies that furnish information to credit bureaus must investigate disputes and ensure the information they report is accurate.

Know Your Rights Under the Fair Credit Reporting Act
The Fair Credit Reporting Act gives consumers important protections when credit bureaus, background screening companies, and data furnishers provide inaccurate information.

- Have disputed information investigated by the company that created the report
- Seek compensation when violations of the FCRA cause financial, reputational, housing, employment, emotional, or other harm

What We Help With
We help consumers fight errors in credit reports, background checks, rental screening reports, and insurance reports. We also help people stand up to abusive and inaccurate debt collection practices, and recover from identity theft. Through guidance, disputes, and lawsuits, we strive for successful outcomes, including corrections and compensation.
Fee-Shifting Structure
Under the FCRA, consumers who need to work with a lawyer to enforce their rights can make the credit bureaus and background check companies pay their legal fees. This process, known as fee-shifting, keeps justice available for everyone who needs it, not just those who can afford it.
